Marbella loses control of planning permission - Posted: 16/01/2006

Marbella council (ayuntamiento) will no longer be responsibility for planning permission. Marbella on the Costa del Sol is the first town in Spain to lose the right to control planning permission for construction projects.

The sanction was announced by the Junta de Andalucia, (Andalucian regional government) as a result of continuous irregularities related to illegal building permits issued by Marbella town council. They feel that it has not intervened strongly enough to prevent projects that had been licensed by the previous town council during the reign of Jesús Gil. Many illegal buildings have been constructed, and the present council has issued licences to illegal residential and commercial developments. The council must abide by rulings from the Junta’s Public Works and Planning Division in Seville, and will not make any profit from planning agreements.

Several Marbella councilors have been prosecuted and jailed over the affair.

Marbella’s new town master plan is now with the Junta’s planning department. Construction has slowed dramatically in Marbella, new build residential properties have dropped by over 45% since 2004.
